It still have. This rule is only for the MPSE Awards. The Academy has its own rules. But, well, today is 01/20 and no Oscar's short-list for Best Sound Editing of Mixing.

To get a nominee the sound editor must be associated or linked to the MPSE. The sound editors of The Artist, Tinker T. S. S e Harry Potter 7.2 are not.So, we still "on" the road to the oscars
