they are talking about where to go then some of the Death Eaters Takes his Wands out.Harry sees that HE says "DOWN"! And They Start Casting Spells The Waitress is listening music on her headphone without realising whats happening then Hermione Frozes The Death Eater the Waitress goes to see and Hermione Shouts at Her': GO LEAVE! I know its bad description but i had to try.
They're talking about where are they going next. Ron suggests TLC, Hermione says it's dangerous, and the famous "If Voldemort really has taken over the ministry...". Then Harry says he left his rucksack at the Burrow. (at this point the Death Eaters enter the cafe) Hermione kind of explains all the things are in her bag. Harry notices the guys are preparing their wands, the attack starts.
The waitress is inside the kitchen with headphones so doesn't hear anything. They duel a bit and at the end Hermione nocks the guy with a Petrificus! (Harry looks her with a WOW-look xD). The waitress go out to the cafe, sees all the mess and Hermione yells at her "LEAVE!"
Wow, I can't believe it. WHY DO THEY HAVE TO INCORPORATE CHEAP COMEDY IN TO EVERY FCKING SCENE? I AM SO MAD. I THOUGHT THIS WAS SUPPOSED TO BE GRITTY AND DARK, FCK ME IT LOOKS LIKE A PILE OF SHIT.
There's a difference between bad comedy and little bits to add more variety to the scene. Plenty of action sequences in cinema history have little quips and moments to help break up the chaos, pretty much every single action film I've ever seen does this.
Indiana Jones, Star Wars, even Lord of the Rings have more light-hearted moments during heavy action. Virtually every film in history has some level of brief comedy, even the dark ones. This film is going to be gritty and dark, but it's still Harry Potter and because it's Harry Potter there will always be elements of light-hearted-ness but that doesn't mean it's a big joke. It doesn't hurt it.

The kids shooting in The Dark Knight, for example.
I mean, again, Lord of the Rings. How many times do we see Legolas and Gimli used as comic relief? And how many times did that actually take away from the scene, atmosphere and mood? Nada.
I understand that this is Potter, and as fans we're very touchy on literally every element. I'm one of them, big time. But I also understand the source material. Deathly Hallows is by far the darkest installment but that doesn't mean there cannot be nice little "haha" moments to "diffuse the tension," as Fred so eloquently puts it in the Polyjuice Potion clip. I don't think anyone would really want 100% of the film to be drop-dead serious because when something takes itself too seriously, it can become a self-parody of itself. This film will be way darker and not as funny as the others, but it can still get away with a few moments.
What WOULD be bad, then, to me, you ask? If say, when Harry is walking to his death in the woods, Sirius farts and they all stop to have a giggle. That would be bad, and would ruin the scene. An employee listening to music on her headphones while a battle ensues in the room behind her is not over the top not does it detract from anything.
