Look at that! She could get 3 years for jaywalking with her kids! Yet the drunk driver who hit the kid is getting 6 months?!?!?! What the fuck, this is like Casey Anthony again, tho not as bad, but still! Wtf is wrong with people....

    When I was living in Orlando, I almost got in trouble for jaywalking. I mean... Over here is totally normal. At least, I could use the excuse that I wasn't from USA and that in my country we don't have this law. The officer accepted it. Haha lol

    Agree with the law or not she broke it. Jaywalking is illegal for this exact reason! It is not safe and she is an adult so she should know better. I agree that the driver should have a far worse punishment but she put her and her children's life in danger when she jaywalked. Cross walks are there to keep people safe. She was three tenths of a mile from the nearest cross walk. Really? Thats so far that you can't walk just over half a mile to get home?

    I am truly sympathetic toward her for her loss and would not wish that on anyone but she is not guiltless.

    Oh I'm not saying what she did is fine, of course not. I'm just outraged that the drunk drive who apparently also took drugs gets 6 months while she gets 3 years. That's the part I'm mad about. What she did was illegal, yes, but being an idiot and jaywalking < drinking and driving. And I agree, I've actually never jaywalked (mainly because anywhere I walk to is very close to a traffic light, so there's no point).

    I would do the same thing though if my house was right across the street from the bus stop. I mean at the end of the day you just want to go home.

    The part that upsets me about that is that he was under the influence and had prior convictions.

    Jaywalking is a form of endangerment. That is why it is illegal. Its not only a danger and a detriment to those walking but those driving as well. Its not as bad as drink driving, I'll agree there. However, many people are killed every year by jaywalking also and it really is another crime of stupidity.

    There was mention of a similar case where the driver wasn't punished at all and that I can't say I disagree with if they were unimpaired.

    I would not do that. Haste makes waste and better safe than sorry. It was night and she just wanted to get inside. It's not a good excuse. I see people jaywalking all the time and it really bothers me. In the grand scheme of things taking an extra 15-20 minutes out of this woman's day to walk to her apartment would have saved her son's life.

    Well.....it looks like she's not going to jail after all:

    "MARIETTA, Ga. (AP) - A woman who was arrested after her 4-year-old son was struck and killed by a van as they were jaywalking across a busy street was spared a prison sentence Tuesday following an outcry over her prosecution.

    Raquel Nelson, 30, was convicted by a jury earlier this month of vehicular homicide and other charges for not using a crosswalk and could have gotten three years behind bars _ far more than the six months the hit-and-run driver served.

    Instead, without explanation, Judge Kathryn Tanksley gave the suburban Atlanta mother a year's probation, ordered 40 hours of community service, and took the unusual step of offering her a new trial. Nelson's lawyer said late Tuesday that she will take the judge up on the offer."

    That's why I almost got in trouble! The housing complex that I lived was in front of the Bus Stop across the street and the cross walk was like.. 300 meters ahead!

    Well, I guess this is really the best she could've hoped for. She already lost a great deal.

    I don't know why she'd want a new trial though. I think its pretty obvious she jaywalked and endangered her children's lives.
